I. Acceptance and The AI Generation Contract
By using the Brand Maker application ("App"), you agree to these Terms of Use ("Terms"). These Terms govern your access to the AI Logo, AI Model, and AI Product Photo generation services. These services involve complex, generative AI technology, and your agreement acknowledges both the immense creative power and the inherent technical limitations of this platform.
II. Intellectual Property and Content Ownership (Your Brand Assets)
A. Ownership of Generated Output
Subject to your full compliance with these Terms, including payment of all required fees, **you retain all rights, title, and interest in and to the Brand Assets** (logos, models, and product images) you create using the App. This includes the right to use the Brand Assets commercially for any legal purpose, including sale, marketing, and distribution. Brand Maker does not claim any copyright in the final generated output.
B. Input Data License
You grant Brand Maker a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your text prompts and un-retained source images (as outlined in the Privacy Policy) solely for the purpose of operating, improving, and developing our AI models and the App services.
III. AI Output Disclaimer: Uniqueness and Liability
A. No Guarantee of Uniqueness (Crucial)
Due to the nature of generative AI models, we **cannot and do not guarantee** that the Brand Assets generated by the App will be entirely unique or that they will not infringe upon the intellectual property of others, particularly trademarks or designs.
**It is your sole responsibility to conduct all necessary intellectual property clearance, including trademark searches and copyright registration, before commercially using any generated logo or brand identity.** You assume all risk and liability for the commercial use of the Brand Assets.
B. Content Compliance
You agree not to use the App to generate any content that is illegal, defamatory, promotes hate speech, or violates the intellectual property rights of others. We reserve the right to delete any non-compliant generated asset and terminate your account without refund.
IV. Subscriptions, Fees, and Payment
Access to the full AI Labs features requires a paid subscription, processed exclusively through the Apple App Store. You are responsible for managing your subscription, cancellation, and refund requests through the App Store's established protocols. We are not liable for any issues related to App Store billing failures.
